The service of Streaming Netflix is not authorized to modify the prices of current subscriptions. This was decided by the Berlin Regional Court and thus enabled legal action by the Federal Association of Consumer Organizations (VZBV), as the association announced on Tuesday in Berlin.
“At Netflix, the conditions are worded so unclearly that they give the group the possibility to arbitrarily increase prices,” said Jana Brockfeld, legal officer at VZBV. The Berlin District Court agreed with the VZBV that the price adjustment conditions were not transparent enough, he said. (AZ: 52 O 157/21)
The verdict, which the VZBV also displays in PDF format on its website [vzbv.de], is said to have fallen on December 16, 2021.
According to the regional court ruling, there must be clear and understandable criteria for fee changes so customers can understand a claimed price change or at least check its plausibility, consumer advocates said.
In its terms of service, Netflix said it had the right to change subscription prices "from time to time" and "in its reasonable discretion to reflect the impact of changes in the total costs associated with our service". .
According to vzbv, the court also objected to a lack of balance in the contract clause. There is a lack of clarity that Netflix is not only allowed to adjust prices upward, but is obligated to reduce prices if costs are reduced, he said. According to the Consumer Advice Centre, the provider of Streaming appealed against the judgment to the Berlin Court of Appeal. (AZ: 23 U 15/22)
